THE FOLLOWING CONTEST IS INTENDED FOR PLAY IN THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA ONLY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS CONTEST UNLESS YOU ARE 18 YEARS OF AGE OR OLDER, OWN A DOG AND ARE A LEGAL RESIDENT OF THE UNITED STATES.

The Mighty Dog® Nation: The Movie Video Contest ("Contest") runs from April 4, 2009 to July 17, 2009. The Contest entry period starts at 9:00 a.m. Eastern Time (ET) on Saturday, April 4, 2009 and ends at 11:59:59 a.m. ET on Saturday, June 20, 2009. Entries postmarked or posted after 11:59:59 a.m. ET on June 20, 2009 will not be considered. Contest sponsored by Nestlé Purina PetCare Company, Checkerboard Square, St. Louis, MO 63164 ("Sponsor"), and administered by Publicis Consultants PR, an independent judging organization.

ELIGIBILITY: Contest offered only in the 50 United States and the District of Columbia to legal residents of the U.S. who own a dog and, at the time of entry, are 18 years of age or older. Entrants under the age of majority (21 if a MS resident, 19 if an AL, NE, or PA resident, 18 in all other states) must have their parent's or legal guardian's permission to enter. Open to amateur videographers only. Persons who have been paid for a personally-produced video are ineligible. Employees of Nestlé Purina PetCare Company, its parent companies, affiliates, subsidiaries, advertising, promotion and production agencies including Publicis Consultants PR, and their immediate family members and persons living in the same household of each are not eligible to enter. This Contest is subject to all federal, state and local laws and regulations. Void where prohibited or restricted by law.

REGISTER TO ENTER: In order to enter this Contest via the online means discribed in the How To Enter section below, you must complete the online Citizenship Application form at www.mightydog.com. It is not necessary to complete the online Citizenship Application in order to view, rate, or pass-along a video, or to participate in the Internet Popular vote as described below. The completion of a brief registration form is required to comment on videos on the Web site.

TERMS OF SUBMISSION: As conditions of entry into this Contest, and by uploading a video submission, each entrant:

1. WARRANTS AND REPRESENTS THAT THE ENTRANT IS THE OWNER OF THE DOG(S) FEATURED IN THE CONTEST VIDEO SUBMISSION;
2. WARRANTS AND REPRESENTS THAT THE ENTRANT OWNS ALL RIGHTS TO THE SUBMISSION THAT HE OR SHE IS SUBMITTING IN THIS CONTEST INCLUDING, WITHOUT LIMITATION, THE VIDEO OR DIGITAL RECORDING AND THE PERFORMANCE CONTAINED IN THE SUBMISSION;
3. WARRANTS AND REPRESENTS THAT THE ENTRANT HAS THE WRITTEN CONSENT, RELEASE, AND/OR PERMISSION OF EACH AND EVERY IDENTIFIABLE INDIVIDUAL PERSON IN THE VIDEO SUBMISSION TO USE HIS/HER RESPECTIVE NAME OR LIKENESS TO ENABLE INCLUSION AND USE OF THE SUBMISSION IN THE MANNER CONTEMPLATED BY THE SPONSOR AND THESE OFFICIAL RULES AND CAN MAKE WRITTEN COPIES OF SUCH PERMISSIONS AVAILABLE TO THE SPONSOR UPON REQUEST;
4. ACKNOWLEDGES AND AGREES THAT, IF AN ENTRANT'S SUBMISSION IS SELECTED AS A FINALIST (SEE ROUND ONE JUDGING BELOW), THE ENTRANT WILL EXECUTE AN AFFIDAVIT OF ELIGIBILITY AND LIABILITY RELEASE, IN WHICH HE/SHE WILL IRREVOCABLY ASSIGN AND TRANSFER TO THE SPONSOR ANY AND ALL RIGHTS, TITLE AND INTEREST IN SUBMISSION, INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHTS, AND WAIVE ALL MORAL RIGHTS IN THAT SUBMISSION. IN ADDITION, SELECTED FINALISTS MUST HAVE ALL IDENTIFIED PERSONS DEPICTED IN THE VIDEO SIGN PUBLICITY/MODEL RELEASES AS PROVIDED BY THE SPONSOR. IN THE EVENT A PERSON DEPICTED IN ANY VIDEO IS UNDER THE AGE OF MAJORITY IN HIS/HER HOME STATE, THE PARENT/LEGAL GUARDIAN OF THAT INDIVIDUAL IS REQUIRED TO SIGN A PUBLICITY/MODEL RELEASE FOR THE MINOR; AND
5. WARRANTS AND REPRESENTS THAT HIS/HER SUBMISSION IS ORIGINAL TO THE ENTRANT AND HAS BEEN LEGALLY OBTAINED AND CREATED, DOES NOT INFRINGE THE INTELLECTUAL PROPERTY, PRIVACY OR PUBLICITY RIGHTS OR ANY OTHER LEGAL OR MORAL RIGHTS OF ANY THIRD PARTY, OR VIOLATE APPLICABLE LAWS OR REGULATIONS AND HAS NOT BEEN PUBLISHED PREVIOUSLY IN ANY MEDIUM OR ENTERED IN PREVIOUS CONTESTS.

IN THE EVENT AN ENTRANT CANNOT PROVIDE ALL REQUIRED RELEASES, SPONSOR RESERVES THE RIGHT, IN SPONSOR'S SOLE DISCRETION, TO DISQUALIFY THE APPLICABLE SUBMISSION, OR SEEK TO SECURE THE RELEASES AND CLEARANCES FOR SPONSOR'S BENEFIT, OR ALLOW THE APPLICABLE SUBMISSION TO REMAIN.

Entrant agrees to indemnify and hold Sponsor and its affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the "Contest Indemnitees"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Contest Indemnitees due to or arising out of the entrant's submission or the entrant's conduct during and in connection with this Contest, including, but not limited to, trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation.

Entrant agrees to release and indemnify and hold harmless Contest Indemnitees from any and all claims that any commercial, advertising, presentation, Web content or any other material subsequently produced, presented, and/or prepared by or on behalf of Sponsor infringes on the rights of entrant's work as contained in any Submission.

HOW TO ENTER: NO PURCHASE OR INTERNET SERVICE SUBSCRIPTION IS NECESSARY TO ENTER OR WIN. After completing the online Citizenship Application form at www.mightydog.com between 9:00 a.m. ET on April 4, 2009 and 11:59:59 a.m. ET on June 20, 2009, you will be offered an opportunity to enter this Contest. To enter, follow the online instructions and then upload your original video and click "SUBMIT". Or, you may print your name, mailing address, e-mail address, date of birth, and home phone number along with your dog's name, age, and breed on an 8 ½ " by 11" piece of paper. Also write the name of the category you are entering as described in the Entry Requirements section of the rules, and write a brief explanation in English in 100 words or less why you believe your dog's mighty behavior fits the description in that category. Mail the paper along with your video submission on VHS or DVD to: Mighty Dog Nation: The Movie Video Contest, P.O. Box 19784, Seattle, WA 98109.

All videos must adhere to ENTRY REQUIREMENTS specified below and cannot be longer than two (2) minutes in length. All eligible videos will be posted to the Mighty Dog website and may be posted on other social media sites.

Limit three entries per person or household. Each entry, whether online or mail-in, must be different, submitted separately and posted or postmarked by 11:59:59 a.m. ET on June 20, 2009. If you submit more than three entries, only the three entries that are received and processed first will be eligible. In the event of a dispute over the identity of an online entrant, the entry will be deemed made by the authorized account holder of the e-mail address at time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, on-line service provider, or other organization, or the domain associated with the e-mail address.

All entries become the property of the Sponsor, which retains all rights including, but not limited to, any intellectual property rights, including copyrights, the right to copy, edit, modify, adapt, publish, and/or use or not use any submissions in any way and in all media, throughout the world, without limitation or further consideration. Sponsor further retains the right, at its sole discretion, to remove or re-record any voiceover that may be contained on a submitted video. No correspondence about entries will be entered into, nor will videos be acknowledged or returned. If required information is not included, entry will be disqualified.

Sponsor is not responsible for late or incomplete entries. If a problem occurs in the on-line submission process you should receive an "Error" message. However, the responsibility to electronically forward the entry is the entrant's and neither Sponsor nor the Contest administrators shall be responsible for any video not actually received due to incomplete or improper transmission. Similarly, neither Sponsor nor Contest administrator has any obligation to advise entrant of an incomplete submission.

Sponsor, Publicis Consultants PR, and/or other Contest administrators may prohibit you from participation in the Contest if, at their sole discretion, you show a disregard for, or attempt to circumvent these Official Contest Rules, or act: (a) in a manner that affects the administration, security, fairness or proper play or conduct of the Contest in any way; (b) with an intent to annoy, threaten or harass any other entrant or the Sponsor; or (c) in any other disruptive manner.

ENTRY REQUIREMENTS: Each submission must include one video in any of the following formats - mov, avi, mp4, mpg, mpeg, flv, or wmv, up to 15MB if submitted on-line, or in VHS, MPEG or DVD format if submitted by mail, and must be no longer than two (2) minutes in length. You may include up to three dogs and two people in any one video; if a video with more than one dog is selected as one of the Grand Prize winners, Sponsor, in its sole discretion, will determine which one of the dogs will appear in Mighty Dog Nation: The Movie. (See "PRIZES" section below).

In this Contest, we are looking for you to show us your dog's Mighty behavior in any one of the following categories:

Front Porch Defender – Mighty soldier on the front line of life, these smart and fearless friends perk to attention with every new visitor, smell, or passing car, and promptly report back on the outside activity. Always on call to alert you to trouble and wondering what took you so long to get there.

The Couch Paw-tato – Although the untrained eye may mistake them for sluggish, these knowledgeable creatures watch with intense focus as life moves all around them. They live by a different set of rules that reward those who can spot the cat on TV first or get to the best seat in the house before their owner. These smart and spirited dogs are most comfortable overseeing house activities from atop their elevated, cushioned perch.

The Inquisitive Headmaster – Whether it's for your sake or theirs, these masters of your domain have plotted the land thoroughly and are to be kept abreast of everything – EVERYTHING! What is in the sack? Why are you behind that door? Why aren't we leaving yet? And where is the food that should've been served promptly at six?

The Inventive Adventurer – These tenacious titans WILL succeed no matter the cost. Blocked Path? Re-routed. Too High? Jumped. Just out of reach? Finagled. These puppies have a thirst for adventure and an imagination mightier than the laws of physics.

The Wagging Walk-On Role – Is your dog Mighty in another way? Create your own mighty role and tell and show us your dog's Mighty behavior.

Dog(s) shown in the video must be owned by the entrant and live in the same household as the entrant. Because Nestlé Purina PetCare Company promotes the compassionate care of all pets, videos depicting animals in unsafe conditions or not exemplifying responsible pet ownership will not be considered. Video submission must be the property and original work of the entrant, may not have been previously distributed, may not have won prior awards, and must not infringe on any third-party rights. Videos taken by professional videographers or film makers, defined as individuals who earn their primary income as a videographer or film maker, will not be accepted or will be disqualified.

No third-party music, logos, or branded products are allowed in videos. When mailing an entry, in addition to including the 8 ½ x 11 information sheet, please affix the entrant's name and address directly to the video. Videos submitted for entry failing to observe any of these requirements in the sole judgment of Sponsor and/or Publicis Consultants PR will be disqualified.

CONSUMER RATING: All videos that meet the Entry Requirements specified above will be placed on the Sponsor's website at www.mightydog.com and other social media sites where, from 9:00 a.m. ET on April 4, 2009 to 11:59:59 a.m. ET on June 20, 2009, consumers will have an opportunity to rate and comment on each video. This rating and commenting process is for entertainment purposes only and will have no effect on the determination of winners, which is described below.

ROUND ONE JUDGING: All videos received within the entry period will be judged by an independent panel of judges based on the following criteria: 1) Appropriateness to the "Mighty Dog Nation: The Movie" theme (demonstrate attitudes bigger than size – maximum 35 points); 2) Mightiness of the Moment (clear demonstration of the entry category behaviors described above – maximum 35 points); and 3) Star Potential (engaging and entertaining – 30 points). Using these judging criteria, up to ten (10) Finalists will be selected and those entries, in original or edited form, will be eligible for posting to the Sponsor's Contest website for popular voting.

FINALIST NOTIFICATION, AFFIDAVITS AND RELEASES: Each of the Finalists will be notified by e-mail and by overnight mail on or before June 27, 2009 and will be required to execute, and deliver to Sponsor within three days of notification a signed Affidavit of Eligibility, Publicity Release and Release of Liability ("Affidavit and Releases"). A winner under the age of majority in their home state must have their parent or guardian sign and execute the Affidavit and Releases. Except where prohibited by law, submission of the completed Affidavit and Releases constitutes permission to use the winner's name, biographical information, likeness, and submitted video for purposes of advertising, promotion and exploitation in all media, including on-line worldwide, without limitation or further compensation. Failure to return the completed Affidavit and Releases within the prescribed three-day time period will result in disqualification and selection of an alternate Finalist.

FINALIST PRIZE: Each Finalist who returns their fully completed and signed Affidavit and Releases within the prescribed 3-day time period will receive a six-month supply of Purina® Mighty Dog® brand canned dog food delivered in the form of forty-six (46) manufacturer's coupons, each good for one (1) free 12-ct variety pack of Purina® Mighty Dog® brand dog food (up to $12.99 each). The maximum total retail value of each Finalist prize is $597.54.

ROUND TWO JUDGING - INTERNET POPULAR VOTE: Up to ten (10) Finalist entries selected in ROUND ONE JUDGING will be posted at www.mightydog.com for popular vote. Starting at noon ET on Friday, July 3, 2009 and ending at 11:59:59 a.m. ET on Friday, July 17, 2009 site visitors will be invited to rate each of the Finalist entries on a scale of 1 (lowest) to 5 (highest). Limit one rating per Finalist per person. Cookies must be enabled for voting. Internet voting will count toward 10% of the total score assigned to each Finalist. The remaining 90% of the total score will be assigned as described in ROUND THREE JUDGING below.

ROUND THREE JUDGING: Each of the Finalist entries will be reviewed and judged by a celebrity judge (to be announced on the Contest website) using the judging criteria listed above in ROUND ONE JUDGING. The scores assigned by the celebrity judge will count as 90% of the overall final score; the remaining 10% will be determined by Internet popular vote as detailed above.

Based on the combined scores of the ROUND TWO Internet Popular Vote (10%) and the ROUND THREE Judging (90%), three (3) Grand Prize winners will be determined.

GRAND PRIZE: Three (3) Grand Prize Winner Prizes will be awarded. The three winning entrants will each receive:

• Up to a one-day film shoot in their home with a professional film production crew (no retail value associated with this portion of the prize);
• A role for the winning dog in the Mighty Dog® Nation: The Movie — a 3-5 minute dog-umentary film that will be shown on www.mightydog.com (no retail value associated with this portion of the prize);
• A role for the winning dog in a 30-second film trailer that will air during a commercial break of the National Dog Show on NBC on Thanksgiving Day, November 26, 2009 (no retail value associated with this portion of the prize);
• A Hometown film premiere party for the winning entrant, dog, and friends and family early in 2010 (date to be determined at Sponsor's discretion). (Estimated retail value of this portion of the prize: $5,000.00)
• A one-year supply of Purina® Mighty Dog® brand canned dog food delivered in the form of ninety-two (92) manufacturer's coupons, each good for one (1) free 12-ct variety pack of Purina® Mighty Dog brand dog food (up to $12.99 each). The maximum total retail value of the dog food portion of this prize is $1,195.08.

The estimated total value of the Grand Prize is $6,195.08.

Limit one prize per person or household. Prizes are not transferable or assignable. There will be no substitution or exchange of any prize except at the sole discretion of the Sponsor. Should any prize or component of a prize be unavailable, for any reason, the Sponsor reserves the right to substitute a prize or prize component of equal or greater value. All applicable taxes and expenses related to the acceptance and use of a prize, including sales tax, are the sole responsibility of the winners.

GRAND PRIZE WINNER NOTIFICATION, AFFIDAVITS AND RELEASES: The Grand Prize winners will be notified by phone, e-mail or postal mail on or before July 22, 2009. Each Grand Prize winner will be required to sign, notarize, and deliver to Sponsor a Release of Liability for himself/herself and any third party involved in the delivery of the Grand Prize, within one week of notification. Failure to supply such documentation within the prescribed one week time period will result in disqualification and selection of an alternate Grand Prize winner.

GENERAL CONDITIONS: By entering, entrants (or, if under the age of majority in their state of residence, their parents or legal guardians) agree: (a) to be bound by these Official Contest Rules and the decisions of the Sponsor, Publicis Consultants/PR, and/or other Contest administrators which shall be final and binding, and (b) that the Sponsor, its parent companies, affiliates and subsidiaries, their respective officers, directors, agents, and employees are not responsible for and shall not be liable for: (1) any incorrect or inaccurate information associated with or utilized in the Contest, whether caused by website users, tampering, hacking, or any of the equipment or programming associated with or utilized in the Contest; (2) any error, omission, interruption, deletion, defect, delay in operation or unauthorized access to the website or in any material associated with the Contest; (3) any injury, damage, or loss to participants' or any other person's computer related to or resulting from participating in this Contest or downloading materials from, or otherwise using, the website; (4) telephone, electronic, hardware or software program, network, internet or computer malfunctions, failures or difficulties; (5) any design, typographical or other errors in any materials associated with the Contest; (6) garbled, illegible, incomplete, damaged, misdirected, late, lost, postage due, undelivered, or unprocessed entries; (7) any condition caused by events beyond the control of the Sponsor which may cause the Contest to be disrupted or corrupted; or (8) any loss, injury or damage of any kind caused by participation in this Contest, or by the acceptance and/or use of any prize. Sponsor reserves the right in its sole discretion to modify, cancel, terminate, or suspend all or any portion of this Contest should fraud, virus, bugs, unauthorized human intervention, systems malfunctions, failures or difficulties, or other causes beyond the control of the Sponsor and its agencies corrupt or affect the administration, security, fairness or proper play or conduct of the Contest.

By entering this Contest you give your consent for Sponsor to deliver your entry material and/or personal information to Publicis Consultants/PR and/or other Contest administrators as required for the purpose of administering the Contest. Only Sponsor, Publicis Consultants/PR and such other Contest administrators will have access to the personal information. Information will be used in accordance with Sponsor's online privacy policy. Submissions that do not comply with these Official Contest Rules or that otherwise contain prohibited or inappropriate content as determined by the Sponsor, in its sole discretion, will be disqualified and will not be placed on the Sponsor's website or considered for a prize. Sponsor makes the final determination as to which submissions are eligible to take part in this Contest and be considered for a prize. Having a submission posted to the Sponsor's website at www.mightydog.com, or any other website, is unrelated to the Judging Criteria and does not guarantee selection as a Finalist or Grand Prize winner.
